Memo No.DIG/OS/2936/09, dated 30-12-2009 of DIG (CAR), Rajahmundry. 2. Proceedings No.DIG/OS/1935/2010, dated 14-10-2010 . of DIG (CAR), Rajahmundry. 3. Proceedings No.EA2/1032/2010, dated 04-06-2011 of the DG &IGP &CS, AP, Hyderabad. 4. Revision petition of Sri K.Sudhakara Rao, Superintendent (Deputy Jailor), Sub-Jail, Tanuku, dated 13-09-2011. 5. From the Director General & Inspector General of Prisons and Correctional Services, AP, Hyderabad, Lr.No.NG-2/821/2011, dated 30-11-2011. * * * * O R D E R: In the reference 1st read above, the following article of charge was issued against Sri K.Sudhakara Rao, Superintendent (Deputy Jailor), Sub Jail, Tanuku. “That the said Sri K. Sudhakara Rao, Superintendent (Deputy Jailor), Sub Jail, Tanuku, West Godavari District while functioning as Sub Jail Superintendent has exhibited gross dereliction towards his duty and disobedience to the orders of superior officers, thus violated of Rule 89 of the A.P. Prison Rules, 1979”. 2. After conducting a detailed enquiry as per APCS (CC &A) Rules, 1991, the following punishment was awarded to the individual vide reference 2nd read above. “Postponement of his next Annual Grade Increment for a period of two years without cumulative effect and without having an effect on his pension”. 3. Aggrieved by the above punishment the individual filed an appeal with the Director General and Inspector General of Prisons and Correctional Services, AP, Hyderabad, and the punishment was modified to that of “postponement of increment for a period of one year without cumulative effect and without having an effect on his pension” vide reference 3rd read above. 4. Vide reference 4th read above, Sri K.Sudhakara Rao, Superintendent (Deputy Jailor), Sub Jail, Tanuku, has submitted the revision petition on hand contending that he never did exhibit dereliction of duties and disobedience to the orders of the superior and also never violated rule 89 of AP, Prison Rules 1989. He disposed of the condemned P.T.O::2:: articles to one stainless Steel merchant for an amount of Rs.484/-, which is comparatively fair amount and remitted the same to the Government account on 29-09-2009 through challan No’s 16752 and 16753 at Sub- Treasury Tanuku. He further informed that one Convict Prisoner (CT.No.885), was seriously sick and he was busy with that and forgot to make entries in the Convict Register. He further states that he has good length of service without blame and blunder. He therefore requested to consider his appeal sympathetically and set aside the orders passed by the Director General & Inspector General of Prisons and Correctional Services, AP, Hyderabad. 5. The Government after careful examination of the revision petition as well as connected records is of the opinion that there is no misappropriation but a procedural irregularity and the punishment is not commensurate with the lapse. 6. Accordingly the punishment of “postponement of increment for a period of one year without cumulative effect and without having an effect on his pension” issued vide reference 3rd read above is hereby modified to that of “warning to be entered in Service Register” under the powers conferred in terms of APCS (CC&A) Rules, 1991. 7. The Director General & Inspector General of Prisons and Correctional Services, AP, Hyderabad, shall take further action accordingly.
