G.S.R. 363 (E).— In exercise of the powers conferred by sub-sections (1) and (2) of Section 12 of the Waqf Act, 1995 (43 of 1995) and Rule 13 of the Central Waqf Council Rules, 1998, as amended by GSR 240(E) dated 22.03.2012, the Central Government hereby makes the following Rules for the various posts of the Central Waqf Council (CWC):- 1. Short title and commencement - (1) These Rules may be called the Central Waqf Council (Group ‘A, B and C’ Non-Gazetted, Non-Ministerial Posts) Recruitment Rules, 2014. (2) They shall come into force on the date of their publication in the official Gazette. 2. Application - These Rules shall apply to the posts specified in column (1) of the Schedule annexed to these Rules. 3. Name of the posts, number of posts, classification, pay band and grade pay/pay scale - The number of said posts, their classification, Pay Band and Grade Pay/Pay Scale as attached thereto shall be as specified in columns 2 to 4 of the aforesaid Schedule. 4. Method of recruitment, age-limit and other qualifications - The method of recruitment to the post, age-limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the said Schedule. 5. Initial Constitution - (1) The personnel holding the posts on regular basis before the commencement of these Rules, shall be deemed to have been appointed in accordance with the provisions of these rules. (2) The regular continuous service of personnel mentioned in the sub-rule (1) prior to the posts at the initial constitution shall count for the purpose of probation period, qualifying service for promotion, confirmation and pension, if any, in the service.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 23 6. Disqualification - No person,- (a) who, has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts. (cid:1) Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 7. Consideration of Seniors - Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying/eligibility service by more than half of such qualifying/eligibility service or two years, whichever is less, and have successfully completed probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/eligibility service. 8. Power to relax – Where the Governing Body is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, and in consultation with the approval of the Central Government, relax any of the provisions of these rules with respect to any class or category of persons. 9.
